I have conducted over 4,500 mediations and obtained settlement in the overwhelming majority of them. The parties enter mediation unsure that a discussion of their disputed matter is going to result in a settlement that meets their needs and expectations. This mediated discussion is not an academic exercise that magically results in an agreement from the mere use of self-determination by the parties. Instead, it is the mediator using his or her knowledge, experience, and skill to challenge the parties which produces a fair resolution of the case.
